Why invest in laws that incentivize culture in Brazil?

Investing in cultural incentive laws in Brazil is crucial to democratizing access to culture, strengthening national identity, stimulating the creative economy, and offering tax benefits to companies. These laws enable projects that would not otherwise exist, generating jobs, fostering talent, and boosting sectors such as audiovisual, music, and theater.

For society

Federal Law No. 8,313/1991, supplemented by Law No. 9,249/95, regulates the tax waiver of Income Tax due for cultural projects, previously approved by the Ministry of Culture. The permitted waiver percentage is up to 4% for legal entities and up to 6% for individuals.

Notes:

  1. Companies that calculate income tax annually based on actual profit, with monthly payments, can calculate 4% on the total annual income tax, regardless of any tax payments already made, apply it to projects, and deduct it in full from a future tax payment for the fiscal year.

  2. Companies that calculate income tax quarterly can calculate 4% on the income tax for the entire quarter, apply it to projects, and deduct it in full from a subsequent tax payment for that period.

State Law No. 12.268/2006 ICMS/SP Law

This regulates the ICMS/SP tax waiver, allowing companies to allocate up to 3% of the ICMS due to cultural projects previously approved by the São Paulo State Department of Culture. Companies interested in allocating these funds must register on the State Department of Finance website using the same username and password as the Electronic Tax Office. In approximately two weeks, the company will receive an email from the Tax Office confirming registration and authorizing the use of the funds, which can be applied monthly.
